2011 MACBOOK PRO LAPTOP (15” OR 17” SCREEN) QUEBEC CLASS ACTION SETTLEMENT

Important: if you received a notice in March 2023, submitted a timely claim before the claim deadline of July 14, 2023 and/or belonged to group C-1.1, a payment was sent to you on September 28, 2023

 

 

In December 2014, a class action was commenced before the Superior Court of Quebec against Apple Canada Inc. and Apple Inc. (collectively “Defendants” or “Apple”) alleging that the 15’’ and 17’’ 2011 MacBook Pro Laptops manufactured by Apple (the “Device(s)”) suffer from a graphics issue or defect (the “Class Action”).

The Plaintiff has been authorized to bring the Class Action on behalf of all persons who live in Quebec and purchased, own, or owned a Device -and- all persons who live elsewhere but purchased such a Device in Quebec.

The parties have negotiated a settlement of the Class Action (the “Settlement Agreement”), which has been approved by the Superior Court of Quebec on May 11, 2021 as fair, reasonable and in the best interests of the Class. The Settlement Agreement provides that Apple agrees to pay $5,344,575.00 in settlement of the Class Action.

In return for the Total Settlement Fund, Defendants will receive a release from all class members and a declaration of settlement out of court of the Class Action.

The settlement is a compromise of disputed claims and is not an admission of liability, wrongdoing or fault on the part of Defendants.


“CLASS” or “CLASS MEMBERS”

 The class is defined as follows:

  1. all persons in Quebec, who purchased and/or own a 2011 MacBook Pro Laptop with a 15 inch or 17 inch screen; and
  2. all persons, who purchased in Quebec a 2011 MacBook Pro Laptop with a 15 inch or 17 inch screen;

Notice has been sent per Apple’s customer records to class members on July 02, 2021 which will indicate the Class Member group they belong to along with detailed instructions on what they need to do, if anything, in order to receive compensation from the Settlement Agreement. The notice will also include individualised login credentials for the claimants to complete any necessary Form online.

 

FILING DEADLINE

Update March 2023: For class members who received notice dated March 16, 2023, the claim submission period will start on March 16, 2023, and will run for 4 months until July 14, 2023. Please note that if you wish to update your address or opt for electronic payment, you must do so BEFORE May 16, 2023

The filing period started on July 02, 2021 and ran for 3 months until October 01, 2021.
